Supreme Court Upholds Obamacare Subsidies

The U.S. Supreme Court has just issued its 6-3 ruling on King v. Burwell, upholding the subsidies established in the Affordable Care Act (ACA).

The issue in this case was whether the ACA’s tax credits should be available in States that have a Federal Exchange rather than a State Exchange.

Chief Justice Roberts explained Court’s decision:

Congress passed the Affordable Care Act to improve health insurance markets, not to destroy them. If at all possible, we must interpret the Act in a way that is consistent with the former, and avoids the latter.

Section 36B can fairly be read consistent with what we see as Congress’s plan, and that is the reading we adopt. The judgment of the United States Court of Appeals for the Fourth Circuit is Affirmed.

This decision — this affirming of the intention of the Affordable Care Act — is great news for the millions who would have risked the loss of subsidies had the decision gone the other way. A big win for Obamacare and secure healthcare for all!
